By accessing our website, booking our services, or visiting our spa facility, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. Kechuadvca B.V. reserves the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.

Service Description

Kechuadvca provides professional spa and wellness services including massage therapy, facial treatments, body treatments, and wellness packages. All services are provided by qualified professionals in accordance with industry standards and health regulations. Service descriptions on our website are for informational purposes and may be subject to availability and modification.

Booking and Payment

Appointments must be booked in advance through our booking system or by phone. Payment is due at the time of service unless other arrangements have been made. We accept cash, credit cards, and debit cards. Prices are subject to change without notice. Any promotional offers are subject to terms and conditions and may have expiration dates or limitations.

Cancellation Policy

Cancellations must be made at least 24 hours in advance to avoid cancellation fees. Cancellations made with less than 24 hours notice may be subject to a 50% cancellation fee. No-shows will be charged the full treatment price. We reserve the right to cancel appointments due to therapist illness, emergency, or other unforeseen circumstances, in which case we will reschedule at no additional cost.

Health and Safety

Clients must disclose any health conditions, allergies, or medical concerns that may affect treatment. We reserve the right to refuse service if we believe it may be harmful to your health or safety. Pregnant clients should consult with their healthcare provider before booking treatments. We maintain strict hygiene and sanitation protocols in accordance with health regulations.

Client Conduct

Clients are expected to behave respectfully toward staff and other guests. Inappropriate behavior, harassment, or disruptive conduct will result in immediate termination of services without refund. Clients must arrive on time for appointments and follow facility rules and guidelines. Mobile phones should be silenced or turned off in treatment areas.

Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Kechuadvca or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission. The Kechuadvca name and logo are trademarks of Kechuadvca B.V. and may not be used without authorization.

Privacy and Confidentiality

We respect your privacy and maintain strict confidentiality regarding your personal and health information. Our privacy practices are detailed in our Privacy Policy. Limitation of Liability

Kechuadvca's liability for any damages arising from the use of our services is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. Our liability does not extend to personal property lost or damaged on our premises. Clients participate in treatments at their own risk and should disclose any health conditions that may be relevant.

Force Majeure

Kechuadvca is not responsible for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, pandemics, or other emergencies. In such cases, we will make reasonable efforts to reschedule appointments or provide alternative arrangements.

Website Use

Our website is provided for informational purposes and to facilitate service bookings. You agree not to use the website for any unlawful purpose or in any way that could damage, disable, or impair our services. We reserve the right to restrict access to our website at any time. Information on our website is subject to change without notice.

Termination

We reserve the right to terminate or suspend your access to our services at any time for violation of these terms or for any other reason we deem appropriate. Upon termination, your right to use our services ceases immediately. Termination does not affect any rights or obligations that accrued prior to termination. Clients may terminate their relationship with us at any time by providing notice.

Gift Certificates

Gift certificates are valid for 12 months from the date of purchase and are non-refundable. Gift certificates cannot be exchanged for cash and any unused balance will be forfeited after expiration. Gift certificates are transferable but cannot be replaced if lost or stolen. Appointments using gift certificates are subject to the same booking and cancellation policies.

Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good faith negotiations. If resolution cannot be reached, disputes will be resolved through binding arbitration in accordance with Dutch law. The arbitration will be conducted in Utrecht, Netherlands, and will be governed by the rules of the Netherlands Arbitration Institute.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any legal action or proceeding arising under these terms will be brought exclusively in the courts of Utrecht, Netherlands. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Severability

If any provision of these Terms of Service is deemed invalid or unenforceable by a court of competent jurisdiction, such provision will be severed from these terms, and the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kechuadvca regarding the use of our services. These terms supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Kechuadvca.
